On December 19, the European Commission officially adopted a ban on the use of Bisphenol A (BPA) in food contact materials due to its potential harm to human health. It also includes other bisphenols that are harmful to the reproductive and endocrine systems.

Following an 18-month phase-out period, BPA will no longer be allowed in any products that come into contact with food or drink, such as the coating on metal cans, reusable plastic drink bottles, water distribution coolers, kitchenware, and food processing equipment. A few, very limited exceptions will be made to the 18-month transition period in cases where no BPA alternatives exist, to avoid supply chain disruption and give industry more time to adapt.

According to the proposal, the main contents of the ban are as follows:

  • Application Scope:

    The ban applies to adhesives, rubbers, ion exchange resins, plastics, printing inks, silicone, varnishes and coatings used in food contact.
  • Ban BPA

    Prohibit the use of bisphenol A and its salts in the production of food contact materials;Delete Substance 151 (CAS: 80-05, bisphenol A) and Substance 154 (CAS: 80-09-1, bisphenol S) from the List of authorized substances in Regulation EU 10/2011;As an exemption, the use of bisphenol A for specific purposes in Appendix II is permitted.

  • Food contact materials and products made with other bisphenol and bisphenol derivatives shall not contain bisphenol A.
  • Prohibit the use of harmful bisphenol and bisphenol derivatives other than bisphenol A The use of harmful bisphenol and bisphenol derivatives other than bisphenol A in the production of food contact materials and products is prohibited unless a specific use authorization is applied for in accordance with Article 9 of EC 1935/2004 and is listed in Appendix II to the draft.
  • Transition

    For disposable FCM final products:
    • Disposable FCM final products manufactured from bisphenol A that comply with the original regulations before the entry into force of this Regulation: may be placed on the market within 18 months after the entry into force of this Regulation.
    • Disposable FCM final products that comply with the original regulations before the effective date of this Regulation and are applicable to the following three categories may be placed on the market within 36 months after the effective date of this Regulation:
      • Containing processed fruits and vegetables, but excluding products defined in Annex I of 2001/112/EC;
      • Fish products as specified in (EC) 853/2004;
      • Disposable FCM final products specially coated with varnish or paint produced by bisphenol A on the outer surface of the metal.
    • Disposable FCM final products that meet the above two requirements can be filled and sealed within 12 months after the end of the transition period, and continue to be sold until stock is exhausted.

For reusable FCM end products:

  • Reusable FCM final products manufactured from bisphenol A that comply with the original regulation before the entry into force of this Regulation: may be placed on the market within 18 months after the entry into force of this Regulation.
  • Reusable FCM final products as parts of special food processing equipment that comply with the original regulations before the entry into force of this Regulation: may be first released within 36 months after the entry into force of this Regulation.
  • Reusable FCM final products that meet the above two requirements may continue to be placed on the market for a period of 12 months after the end of the transition period.
